Terms of Service

1. Acceptance of Terms

By accessing or using FlashPrep ("the Service"), accessible from flashprep.me, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

FlashPrep is an AI-powered study tool that converts user-submitted text and documents into flashcards. The Service includes:

• AI-powered flashcard generation from text and PDF uploads.
• Spaced repetition study modes.
• Anki (.apkg) and CSV export functionality.
• Cloud storage for generated decks.

3. User Accounts

To access Pro features, you must create an account. You agree to:

• Provide accurate email information.
• Maintain the security of your account credentials.
• Notify us immediately of any unauthorized access.

Age Requirement: You must be at least 13 years old to use this Service. If you are in the EU or other regions where the age of digital consent is older (e.g., 16), you must meet that age requirement.

4. Acceptable Use

You agree NOT to:

• Upload illegal, harmful, or malicious content.
• Upload entire copyrighted textbooks in violation of Fair Use laws.
• Reverse engineer, decompile, or attempt to extract the source code or "System Prompts" of the Service.
• Share your Pro account credentials with others (account sharing is prohibited).
• Use automated tools to scrape or extract data.
• Abuse the referral system by creating fake, duplicate, or disposable accounts to farm generation credits. Referrals are capped at 10 per account. Fraudulent referrals will result in credit reversal and possible account suspension.

5. Content Ownership & Data Retention

Your Content

You retain ownership of the text and files you submit. By using the Service, you grant us a limited, worldwide license to process your content solely for the purpose of generating flashcards.

Source File Deletion (Our Commitment)

We do not permanently store your uploaded source files (PDFs).

• Processing: Your file is sent to our AI processor immediately upon upload.
• Deletion: Once the flashcards are generated, the source file is permanently deleted from our temporary storage.
• Result: We only store the final generated flashcards in your account.

Generated Output

You own the flashcard decks you create and may export them for use in other applications like Anki.

Public & Shared Decks

When you make a deck public, you agree to the following:

• Your Responsibility: You are solely responsible for the content in your shared decks. Do not share decks containing copyrighted material, offensive content, or personal information of others.
• License to Share: By making a deck public, you grant FlashPrep and other users a non-exclusive, royalty-free license to view, copy, and study from your deck within the Service.
• Takedown: We reserve the right to remove any public deck at our sole discretion, including decks that violate these Terms, contain inappropriate content, or are reported by other users.
• No Guarantee: We do not review, endorse, or verify the accuracy of public decks created by other users. Use them at your own discretion.

6. Subscription & Payments

Payment Processors

We use the following payment processors to handle transactions:

• PayPal: For credit card, debit card, and PayPal balance payments. Your payment information is securely processed by PayPal and is subject to their Privacy Policy and User Agreement.
• LemonSqueezy: As an alternative payment processor and Merchant of Record. Use of your data by LemonSqueezy is subject to their Privacy Policy and Terms.

Payment Terms

• Subscriptions: Pro plans renew automatically unless cancelled via your account settings.
• Taxes: LemonSqueezy handles all global sales tax/VAT collection and remittance.
• Cancellation: You may cancel at any time. Your access remains active until the end of the billing period.

Refund Policy

• 14-Day Guarantee: We offer a full refund within 14 days of your first purchase if you are unsatisfied. Contact support@flashprep.me to request it.
• Lifetime Plans: Refundable within 14 days, provided you have not abused the export feature (e.g., downloading thousands of cards then asking for a refund).

7. AI Disclaimer & Educational Warning ("The Exam Clause")

THE SERVICE USES ARTIFICIAL INTELLIGENCE (OPENAI).

• Accuracy: AI models can hallucinate (make up facts). We do not guarantee that generated definitions, dates, or formulas are 100% accurate.
• Verification: You acknowledge that FlashPrep is a study aid, not a replacement for official textbooks or instructors. You agree to verify all generated content against your official study materials.
• No Liability for Exams: We are NOT responsible for any exam failures, academic penalties, professional certification denials, or incorrect medical/legal knowledge resulting from your use of this Service.

8. Service Availability

We strive for 99% uptime but do not guarantee uninterrupted access. We are not liable for data loss due to server outages or third-party (OpenAI/Supabase) failures.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLASHPREP AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (OR $0 IF YOU ARE A FREE USER).

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

11. Account Termination

We may suspend or terminate your account if you violate these Terms (e.g., sharing accounts or uploading illegal content). You may delete your account and data at any time via Settings.

12. Dispute Resolution & Arbitration

You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through the following process:

• Informal Resolution First: Before filing any formal proceeding, you agree to contact us at support@flashprep.me and attempt to resolve the dispute informally for at least 30 days.
• Binding Arbitration: If informal resolution fails, you agree to resolve the dispute through binding arbitration rather than in court, except for small claims that qualify for small claims court in your jurisdiction.
• No Class Actions: You agree to resolve disputes with us on an individual basis only. You waive any right to participate in a class action, class arbitration, or representative proceeding.

This arbitration clause does not apply where prohibited by your local consumer protection laws.

13. Changes to Terms

We may modify these Terms at any time. Significant changes will be communicated via email or a prominent banner. Continued use constitutes acceptance.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the courts of Pangasinan, Philippines.
